1. About Us
We are Magic Flower TD (“we”, “us”, “our”), an online flower and gift retailer operating in the United Kingdom through https://magicflowertd.co.uk.
These Terms of Service (“Terms”) apply to your use of our website and to any order you place with us for flowers, bouquets, gifts, subscriptions, or related products (together, the “Products”).
By placing an order through our website, you confirm that:
- the information you provide is true, accurate, current, and complete;
- you are authorised to use the payment method submitted with your order; and
- you accept these Terms.
These Terms form the entire agreement between you and us in relation to your order.
If you need to contact us, you may do so using the contact details published on our website.
2. Important Product Information
Some flowers, plants, foliage, and berries may be harmful or poisonous if handled incorrectly or ingested by humans or animals. Care should be taken when handling all flowers and plants.
All flowers, foliage, and berries included in our bouquets are supplied for decorative purposes only and are not intended for human or animal consumption.
3. Placing an Order
Please follow the instructions on our website to place your order.
Each order you place is an offer to purchase the Products listed in your order subject to these Terms. You are responsible for checking your order carefully before submitting it and ensuring that all details, including recipient details and delivery information, are correct.
After you place an order, we will send you an email or SMS confirming that we have received and accepted your order (“Order Confirmation”). If you do not receive an Order Confirmation, you should contact our customer support team promptly.
We may reject an order at our discretion, including where:
- a Product is unavailable;
- the delivery location is outside our service area;
- there is an issue with payment authorisation;
- pricing or product information has been displayed incorrectly; or
- we reasonably suspect fraud, misuse, or unauthorised activity.
If we cannot fulfil your order, we will notify you and, if payment has already been taken, refund any amount paid, including any delivery charge where applicable.
4. Product Availability and Substitutions
All Products are subject to availability.
In the event of supply issues, seasonal shortages, quality concerns, or other operational reasons, we reserve the right to substitute flowers, foliage, packaging, or other elements of a bouquet with alternatives of equal or greater value and a similar style, without prior notice.
Where reasonably possible, we may contact you in advance to discuss an appropriate substitute, but we are not obliged to do so.
5. Product Description and Images
Images of our Products on the website are for illustrative purposes only.
Because flowers are natural products, variations are normal. Colours, size, shape, arrangement, wrapping, and presentation may differ slightly from the images shown. Measurements, weights, and dimensions listed on our website are approximate only.
Minor variations do not amount to a defect.
6. Freshness Guarantee
We guarantee the freshness of our bouquets for 7 days from the date of delivery, provided that the bouquet has been properly cared for after delivery.
If your bouquet does not remain fresh for 7 days, we may, at our discretion, offer a replacement or other appropriate remedy, subject to receiving sufficient evidence and your compliance with our claims process.
This guarantee does not apply where deterioration results from:
- improper care after delivery;
- exposure to extreme conditions;
- delayed receipt caused by incorrect delivery details; or
- normal characteristics of certain flower varieties.
7. Subscription Services
7.1 Ongoing Subscriptions
Where you purchase a subscription, you agree to receive recurring deliveries of bouquets at the frequency selected during checkout.
Your subscription will continue until cancelled in accordance with these Terms.
7.2 Managing Your Subscription
You may request changes to your subscription, including delivery frequency, recipient details, bouquet preferences, pause requests, or cancellation:
- through the “My Account” area, where available; or
- by contacting customer support.
To take effect for the next scheduled delivery, changes must be requested no later than 9:00am, 4 days before the delivery date.
During peak periods, including but not limited to Valentine’s Day, Mother’s Day, and Christmas, we may require longer notice of up to 10 days.
7.3 Pausing a Subscription
You may pause your subscription subject to the same notice requirements above. If your request is received after the applicable deadline, the next delivery may still be processed and the pause will apply after that delivery.
7.4 Subscription Payments
Your chosen payment method will be charged:
- when the subscription is first created; and
- thereafter, 4 days before each scheduled delivery.
We may change subscription pricing in the future due to supplier costs, inflation, market conditions, or other operational reasons. If we do, we will give advance notice, and you will have the opportunity to cancel before the new price takes effect.
7.5 Abuse or Misuse
We reserve the right to suspend, restrict, or cancel any subscription where we reasonably suspect misuse, abuse, fraud, or a breach of these Terms.
8. Promotional Subscription Offers
From time to time, we may offer discounted subscriptions linked to an initial purchase. Any such promotion is subject to the specific terms displayed at checkout in addition to these Terms.
8.1 30% Discount Offer
Where you accept a promotional offer giving 30% off your current order in exchange for joining a subscription:
- you agree to begin a recurring flower subscription in addition to your one-time order;
- the subscription bouquet details, frequency, and price will be those stated at checkout;
- your first subscription bouquet will be delivered on the date stated at checkout, typically 28 days after the discounted order.
This discount is conditional on you maintaining the subscription until at least the second subscription bouquet has been delivered.
If you cancel earlier, we reserve the right to revoke the discount and charge the price difference between the discounted price and the full price of the original order.
8.2 50% or 70% First Bouquet Subscription Offer
Where we offer a 50% or 70% discount on the first bouquet of a subscription, the discount applies only to the first subscription delivery.
By accepting this offer, you agree that:
- the subscription will renew at the standard subscription rate after the first discounted bouquet;
- payment for future bouquets will be taken 4 days before each scheduled delivery; and
- you must keep the subscription active until at least the second bouquet has been delivered.
If the offer states that cancellation before the second delivery is not permitted, that condition applies to the promotion.
After the second bouquet has been delivered, the subscription may be cancelled in line with the standard notice period set out in these Terms.
9. Prices
All prices shown on our website are in pounds sterling and include VAT where applicable, unless stated otherwise.
Prices are correct at the time displayed but may change at any time before you place your order.
Delivery charges, subscription charges, and any optional extras will be shown during checkout.
10. Payment
Payment is taken when you place your order, unless otherwise stated for subscriptions or promotional arrangements.
By submitting payment, you confirm that:
- the card or payment method used belongs to you or you are authorised to use it;
- all payment details provided are valid and accurate.
All card payments are subject to validation checks and authorisation by the card issuer. If payment is declined, we are not responsible for any delay or non-fulfilment of the order.
We may refuse or suspend performance where full payment has not been received.
We accept payment methods displayed on our website, which may include Visa, Mastercard, PayPal, Apple Pay, Google Pay, and other methods advertised from time to time.
11. Delivery
11.1 Delivery Address
Products will be delivered to the address provided in your order. You are responsible for ensuring that all delivery details are accurate and complete.
If you know the recipient may not be available, you should provide clear delivery instructions where permitted.
Once delivery has been completed, responsibility for the Product passes to you or the recipient, except where loss or damage is caused by our negligence.
11.2 Failed Delivery
If delivery cannot be completed because the recipient is unavailable, access is not possible, or the address is incorrect or incomplete, the bouquet may be returned to our premises or held by the courier where possible.
If redelivery is available, an additional delivery charge may apply. Unless required by law, no refund will be given in these circumstances.
11.3 Delivery Times
Any delivery dates, time slots, or estimated windows are estimates only unless we have expressly agreed otherwise in writing.
We will make reasonable efforts to deliver on the selected date, but we do not guarantee exact delivery times, particularly where third-party couriers are used or where delays arise from events outside our control.
11.4 Same-Day Delivery
Where same-day delivery is offered, availability depends on order cut-off times, courier availability, delivery location, weather, traffic, and operational constraints.
We reserve the right to decline or reschedule same-day delivery where fulfilment is not reasonably possible.
11.5 Third-Party Delivery Services
For some deliveries outside London or in other selected areas, we may use third-party couriers or postal operators, including tracked but non-signed services.
Where a third-party delivery service is used:
- tracking may be provided where available;
- delivery instructions may not always be followed exactly;
- precise delivery timing cannot be guaranteed; and
- delays outside our reasonable control may occur.
We are not liable for delays caused solely by third-party couriers where we have dispatched the order on time and with reasonable care.
11.6 Reporting Delivery Problems
If your order has not been delivered, or there is another delivery issue, you must contact us as soon as reasonably possible.
Claims for non-delivery should be reported within 3 days of the intended delivery date. Failure to notify us within 7 days may affect your eligibility for any refund or replacement, except where your statutory rights say otherwise.
12. Cancellation Rights
12.1 Perishable Goods
Flowers and bouquets are perishable goods and are generally exempt from the standard 14-day cancellation right once preparation has begun.
Orders for bouquets may be cancelled within 30 minutes of purchase for a full refund, unless preparation or dispatch has already started sooner.
After that period, cancellation may not be possible due to the perishable and bespoke nature of the Products.
12.2 Non-Perishable Goods
If you order non-perishable goods, you may have statutory cancellation rights under consumer law. Where applicable, those rights remain unaffected.
12.3 How to Cancel
To request cancellation, you must contact us using the contact details on our website.
13. Cancellation by Us
We may cancel your order if:
- stock is unavailable;
- the delivery address is not serviceable;
- there is a pricing or product description error;
- payment cannot be authorised; or
- we reasonably suspect fraud or misuse.
If we cancel after taking payment, we will refund the amount paid as soon as reasonably possible.
14. Refunds and Replacements
We are committed to supplying fresh, high-quality products. Refunds or replacements may be offered where a valid issue is established.
14.1 When a Refund or Replacement May Be Considered
A claim may be considered where:
- the bouquet delivered materially differs from the product description, excluding permitted substitutions;
- the bouquet arrives materially damaged or not fresh;
- there is a serious delivery failure attributable to us; or
- the Product has materially deteriorated due to mishandling before delivery.
Minor or natural variations in flower type, shade, arrangement, size, or presentation are not grounds for a refund.
14.2 Remedies
Where a claim is valid, we may choose one of the following remedies:
- a full refund;
- a partial refund;
- a replacement bouquet; or
- a refund of delivery charges only.
The remedy offered will depend on the nature and severity of the issue.
14.3 How to Make a Claim
To request a refund or replacement, you should:
- contact us promptly;
- provide your order number and delivery details; and
- provide clear photographic evidence where relevant.
We may reject claims where insufficient information is provided or where the claim is made too late to investigate properly.
14.4 Exclusions
Refunds or replacements will not usually be offered for:
- permitted substitutions;
- natural variation in fresh flowers;
- incorrect delivery details provided by you;
- missed delivery caused by recipient unavailability;
- dissatisfaction based only on personal taste where the bouquet substantially matches its description; or
- deterioration occurring after successful delivery, unless covered by our freshness guarantee or your statutory rights.
Nothing in these Terms limits your legal rights under applicable consumer protection law.
15. Liability
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation; or
- breach of your statutory consumer rights.
Subject to the above, we are responsible only for losses that are a reasonably foreseeable result of our breach of these Terms.
We are not liable for:
- indirect or consequential losses;
- business losses, including loss of profit, revenue, data, contracts, goodwill, or business interruption; or
- delays or failures caused by events outside our reasonable control.
16. Events Outside Our Control
We are not liable for failure or delay in performing our obligations where caused by circumstances beyond our reasonable control, including:
- severe weather;
- natural disasters;
- fire, flood, or pandemic;
- war, terrorism, civil unrest, or government action;
- strikes or labour disputes;
- power, transport, telecommunications, or courier failures.
Where such events occur, we may suspend, delay, or cancel affected orders.
17. Website Use
Our website is made available free of charge.
We do not guarantee that the website, or any content on it, will always be available, uninterrupted, secure, or error-free. We may suspend, withdraw, or restrict access for business, maintenance, legal, or operational reasons.
You must not misuse our website by knowingly introducing malware, attempting unauthorised access, interfering with systems, or carrying out denial-of-service or similar attacks.
We may report unlawful activity to the relevant authorities.
18. Intellectual Property
All content on our website, including text, images, graphics, product descriptions, branding, logos, software, layout, and design, is owned by or licensed to us and is protected by intellectual property laws.
You may use the website only for personal, non-commercial purposes and only in accordance with these Terms. You must not copy, reproduce, modify, distribute, publish, transmit, display, or exploit any part of the website without our prior written permission.
19. Damage to Devices
We take reasonable steps to keep our website secure, but we do not guarantee that it will be free from bugs, viruses, or other harmful material.
You are responsible for using appropriate antivirus software and ensuring your devices are suitable for accessing our website.
We are not liable for damage to your devices or digital content unless caused by our negligence or failure to use reasonable care.
20. Privacy
Your use of our website and our handling of your personal data are governed by our Privacy Policy, available on our website.
21. Third-Party Rights
These Terms are between you and us only. No third party has any right to enforce any part of these Terms.
22. Changes to These Terms
We may update these Terms from time to time. The latest version will always be published on our website.
Any changes will apply to orders placed after the revised Terms are posted. Orders already accepted will continue to be governed by the Terms in force at the time of acceptance, unless the law requires otherwise.
23. Assignment and Transfer
We may assign, transfer, subcontract, or otherwise deal with our rights and obligations under these Terms, provided this does not reduce your legal rights.
You may not transfer your rights or obligations under these Terms without our prior written consent.
24. Severability
If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be treated as removed, but the rest of the Terms will remain in full force and effect.
25. Waiver
If we delay or fail to enforce any right under these Terms, that does not mean we waive that right.
26. Governing Law and Jurisdiction
These Terms, your use of the website, and any contract between you and us are governed by the laws of England and Wales.
The courts of England and Wales will have jurisdiction, except where consumer law allows you to bring proceedings in another part of the United Kingdom.
All contracts are concluded in English.
